Emergency Legal Lifeline for Officers:

The U.S. Law Shield Emergency telephone is answered 24/7 by an experienced law enforcement program attorney who can immediately take your information, render preliminary advice and instructions, dispatch a law enforcement program attorney to meet with you, and forward your information to the attorney who will be advising and representing you.

You will not be talking to a telephone operator at a Call Center. You will be talking to a law enforcement Program lawyer.

Attorney to Scene:

You will have an attorney at the scene of the incident, for preparation and representation at any interviews, grand jury investigation, and representation in any criminal and/or civil trial in which you are the accused.

Coverage Options

No Firearm Carry Permit? No problem.

If you don't have a handgun carry permit issued by your state or concealed carry permit, you are eligible for the Firearms Program that covers you anywhere in your membership state where you can legally possess a firearm without a license. This program also includes coverage for the use of all other legal weapons.

What's Not Covered

While our services are quite comprehensive, the following are not covered: expert witness fees, governmental fees of any type, investigator fees, or bail bonds. However, members have the option to enroll in the Bail Bond/Expert Witness program.

Officers may purchase the presently described additional legal services contract coverage for their spouse or domestic partner and minor children. This coverage is for all "uses of force" occurring anywhere in Texas, in which member's spouse or minor child has justification as a legal defense.

Multi-State Firearms Coverage for LEO. Carry your firearm outside of Texas? Under the optional multi-state firearms coverage, if our Member Officer has to "use their firearm" in any covered state, they enjoy the same legal protection.

The covered states under the multi-state option are the following: all 50 states plus Washington, D.C.

Career Shield Protection

Employer/employee relationship coverage beyond Use of Force. Our Member can add Employer/Employee relationship coverage for a small monthly fee, then if our Member needs legal assistance in dealing with the Officer's employer, department, agency, etc., it is included for defense against adverse actions: disciplinary, administrative, etc.

Who is eligible to join the U.S. Law Shield Law Enforcement Legal Defense Program?

All active, or honorably retired, sworn Law Enforcement Officers. Full-time, part-time and reserve.


What is covered by the plan?

Defense of criminal charges related to your use of force, on or off duty, in state or federal court in connection with your position as a law enforcement officer.

Defense of any civil claims resulting from any action related to your on or off duty use of force or deadly force in connection with your position as a law enforcement officer.

Defense of a disciplinary or administrative action resulting from the on or off duty use of force or deadly force in connection with your position as a law enforcement officer.


What if I am an active officer and I want more than just "Use of Force" coverage?

Not a problem. By electing to subscribe to our Career Shield - Employer/Employee Relationship Coverage for a few dollars more, you can receive legal representation (criminal, administrative/disciplinary, civil) in all other matters not involving "Use of Force" issues which are initiated against you as a result of performance of your duties. The Career Shield - Employer/Employee Relationship Coverage also provides administrative/disciplinary representation on matters alleged to have occurred off-duty whether related to performance of duty as a peace officer or not.

When does my coverage begin?

You are fully covered immediately upon paying your membership fee.


How do I reach my lawyer in an emergency?

Simply dial the Emergency Lawyer Hotline located on the back of your membership card. Your call will be answered by your lawyer, not someone taking a message.


What if I am involved in an incident in a rural area or somewhere away from a major metropolitan area?

A Law Enforcement Program lawyer will be available immediately to provide legal advice. We will immediately dispatch the closest network attorney to come to your location to provide legal counsel during any interview or questioning.

Does the program cover accidental or unintended discharges?

Yes, provided that you legally possess the firearm in a place where possession of the firearm is legally allowed.


I Just Had to Use Deadly Force…

The moments after an incident are critical. If you do or say the incorrect thing, it may mean the difference between keeping your legal rights and waiving them. These legal rights may ultimately be the difference between preserving your freedom, or not! Therefore, we recommend the following as good procedures after a serious incident.

  • Comply with your agency's General Orders and policies.
  • After controlling the threat, either call the U.S. Law Shield's Law Enforcement Legal Defense Hotline or if unable to do so yourself, have a fellow officer do so for you.
  • If you need medical treatment, do not decline it.
  • Other than minimal oral statements to insure officer and public safety, make no statements to fellow officers or investigators until after you have spoken with your U.S. Law Shield Law Enforcement program attorney.
  • Remember that comments made to fellow officers, association or union officials, and friends are not "privileged" or "confidential" and can be used against you.
  • Inform your supervisors and investigating officers that you are represented by legal counsel, and would like to delay oral/written statements (whether under Garrity, Miranda or otherwise) and any walk through until after you have had an opportunity to privately discuss the incident with your attorney.
  • When time to submit any official report or statement, allow your attorney to review the report or statement first.
  • Do not speak with news reporters. If confronted by reporters at the scene, the hospital, your workplace, your home, etc, politely refer them to your U.S. Law Shield Law Enforcement program attorney and walk away.

Members will be matched with an attorney nearest their area of residence/employment. A Use of Force incident may, in some cases, result in a Member receiving the services of more than one attorney. For example, a Member may have an attorney who excels at call-outs to the scene of a critical incident and representation in grand jury and criminal matters; a second attorney who specializes in internal affairs investigations and disciplinary appeals; and a third attorney who is a civil litigator experienced in defending law enforcement personnel. About Us

U.S. Law Shield's Law Enforcement Program and Texas Law Shield Firearms Program, are provided by Texas Law Shield, LLP, a licensed legal services company founded by attorneys who wanted to put a strong emphasis on the word "service" in legal services plans. U.S. Law Shield's Law Enforcement Program wanted to create a vehicle to deliver affordable legal representation to all law enforcement officers in Texas, its members, with no co-pay or out of pocket fees, no caps, and no pay now and be reimbursed later schemes.

U.S. LAW SHIELD – LAW ENFORCEMENT LEGAL DEFENSE PROGRAM
LEGAL SERVICE CONTRACT

PROGRAM DESCRIPTION

The U.S. Law Shield – Law Enforcement Legal Defense Program is a prepaid legal service program dedicated to providing top legal services at a realistic individual cost for the men and women of Texas law enforcement in order to protect their individual rights and interests in the event they might face civil liability, criminal proceedings or administrative discipline for any situation that involves the use of force. The program is offered only to Texas peace officers, retired peace officers, reserve Texas peace officers, and Federal law enforcement officers, as described below under “Program Eligibility.” The U.S. Law Shield – Law Enforcement Legal Defense Program is administered by Texas Law Shield, LLP, a Texas legal service company operating under the laws of the State of Texas (Tex. Occ. Code Ann. §§ 953.001, et seq.).

DEFINITIONS

The following definitions apply to this Legal Service Contract:

  1. “Contracting Attorney” – A licensed attorney that U.S. Law Shield contracts with to provide legal services for the Legal Service Contract Holder under this Legal Service Contract.

  2. “Legal Service Contract” – The present agreement entered into between Legal Service Contract Holder and U.S. Law Shield for consideration and under which U.S. Law Shield will obtain legal services for the Legal Service Contract Holder through a Contracting Attorney.

  3. “Legal Service Contract Holder” – Person who purchased the U.S. Law Shield’s Legal Service Contract. For the purposes of this Legal Service Contract, the Legal Service Contract Holder and any other covered person under this Legal Service Contract, as applicable may also be referred to as the “Officer.”

  4. “U.S. Law Shield” – For purposes of this Contract shall be the same as Texas Law Shield, LLP.

PARTIES

The parties to this Legal Service Contract are as follows:

  1. This Legal Service Contract is administered by U.S. Law Shield which shall provide Legal Service Contract Holders with a Contracting Attorney for any incident covered by this Legal Service Contract. U.S. Law Shield shall offer the Legal Service Contract in the State of Texas. The Contracting Attorney shall perform the legal services described herein.

  2. The person purchasing this Legal Service Contract is the Legal Service Contract Holder and shall benefit from the legal services provided by U.S. Law Shield. The benefits provided under this Legal Service Contract shall be available to the Legal Service Contract Holder whose payments are current.

  3. _____________________, is the sales representative who sold or solicited this Legal Service Contract on behalf of U.S. Law Shield.

PROGRAM ELIGIBILITY

The Legal Service Contract Holder must be at least one of the following:

  1. A Peace Officer licensed by the Texas Commission on Law Enforcement Officer Standards and Education or under the agency’s new name of Texas Commission on Law Enforcement (“TCOLE”), or similar agency with this accreditation process.

  2. An honorably discharged Peace Officer having a retired status with either TCOLE or the United States Government.

  3. A reserve Peace Officer licensed by TCOLE who is currently commissioned by a Texas law enforcement agency.

  4. A Peace Officer, Agent, or Special Agent employed by an agency of the United States Government and is assigned to perform such duties in the State of Texas.

EFFECTIVE DATE OF LEGAL SERVICES CONTRACT:

The legal services described in this Legal Service Contract shall be available to the Officer who enrolls in the U.S. Law Shield – Law Enforcement Legal Defense Program and pays the contract fee due under the Legal Service Contract. The effective date of this Legal Service Contract is the date the first contract fee payment is received from the Officer. The term of this Legal Service Contract is twelve (12) months from the effective date. The term of this Legal Service Contract shall automatically extend for an additional twelve (12) months on the anniversary of the effective date, unless this Legal Service Contract is terminated in writing by the Officer or cancelled by U.S. Law Shield.

BASE COVERAGE LEGAL SERVICES AND BENEFITS

The consideration paid by the Officer entitles the Officer to the following legal services provided by a Contracting Attorney. These services may be utilized by calling the U.S. Law Shield – Law Enforcement Legal Defense Program at the telephone number(s) provided on the Officer’s membership card. Current, active membership in the U.S. Law Shield – Law Enforcement Legal Defense Program entitles the Officer to all of the following:

  1. Legal representation by a Contracting Attorney in any use of force situation that has the potential to subject the Officer to liability for damages related to his or her acts or omissions that occur in Texas. For the purposes of this Legal Services Contract, “use of force” includes any use of physical force that is related to a law enforcement service or function, which includes acts or omissions while the Officer is acting in the capacity of an off-duty officer, so long as those acts or omissions are performed in the furtherance of a legitimate law enforcement purpose;

  2. Legal representation in connection with any criminal investigation or prosecution occurring in Texas arising out of the Officer’s use of force that occurred in Texas;

  3. Legal representation in, and attorney consulting services in connection with, any internal affairs investigation and representation in any disciplinary hearings or appeal of disciplinary actions imposed as a result of use of force issues (including ancillary or additional alleged misconduct coinciding chronologically with and related to such use of force incident that occurred in Texas) provided that the allegations are not related to blatant criminal activities of the Officer;

  4. Access to the U.S Law Shield – Law Enforcement Legal Defense Program’s twenty-four hour a day, seven day a week hotline. This hotline is answered and maintained by contracting attorneys, and is available for any use of force situation that arises in which the Officer believes that representation might be needed, or if the Officer believes that he or she would benefit from the advice of counsel;

  5. If the contracting attorney representing an officer determines a necessity for an expert witness in the area of justification of the use of force, Legal Service Contract Holder shall be provided with an expert who has agreed to TLS’ standard terms of engagement in the area of reasonableness and justification of the use of force or deadly force under the law. Legal Service Contract Holder may at all times employ any expert witnesses, different than any provided under this contract, however, Legal Service Contract Holder shall be responsible for all fees, costs and expenses of any different expert witnesses and shall receive no reimbursement under this contract;

  6. This agreement provides no benefit for any incident that took place prior to the effective date of this Legal Services Contract or after its termination;
  7. All attorneys’ fees for the contracting attorney are included at no charge to Member for a covered event; and
  8. Reasonable and customary arbitration fees.

OPTIONAL ADDITIONAL SERVICES AND BENEFITS

  1. Career Shield – Employee/Employer Relations Coverage (Optional Coverage)

    For an additional fee (see “Legal Services Contract Pricing” below), the Officer may purchase the presently described additional legal services contract coverage for Employer/Employee disputes. This covers Legal Contract Holder’s defense in any actions by Employer against Employee related to employment of the Officer as to any actions or claims related to law enforcement employment or a law enforcement function.

  2. Multi-State Firearms Coverage for LEO (Optional Coverage)

    For an additional fee (see "Legal Services Contract Pricing" below), the Officer may purchase the presently described additional legal services contract coverage for Multi-State that covers the Officer in a "Covered State" for any use of force incident involving a firearm in which the Officer is lawfully carrying a firearm pursuant to the Law Enforcement Officers' Safety Act or other similar laws or regulations. Currently in place, the covered states are all fifty states and Washington D.C.

  3. Spouse/Children Coverage (Optional Coverage)

    For an additional fee (see “Legal Services Contract Pricing” below), the Officer may purchase the presently described additional legal services contract coverage for their spouse or domestic partner and minor children. This coverage shall be for all “uses of force” occurring anywhere in Texas, in which member’s spouse or child has justification as a legal defense. If spouse or minor child is an active duty peace officer, in order to receive the coverage described above under “Base Coverage Legal Services and Benefits” Paragraphs (1)-(8), spouse or minor child must separately purchase his or her own base membership.

DUTIES OF LEGAL SERVICE CONTRACT HOLDER

  1. The Officer has a duty to promptly notify U.S. Law Shield if he or she is involved in a use of force situation that the Officer believes could result in a legal investigation by any person or department, criminal proceedings or incident that may give rise to coverage under this contract.

  2. The Officer agrees to cooperate fully with U.S. Law Shield to determine any issue of coverage, or lack thereof.

  3. If there is determined to be coverage under this Legal Services Contract, the officer agrees to cooperate fully with the Contracting Attorney in the defense of the Officer’s use of force at any legal proceeding, attend any and all court dates, court hearings, and other official appearances in connection with any charges or lawsuits that are brought against the Officer as a result of his or her use of force. The Officer agrees to immediately inform the Contracting Attorney of anything that might prevent the Officer from attending scheduled court dates or appearances.

  4. It is agreed that the Officer will keep all appointments with U.S. Law Shield or any Contracting Attorney and, if an unexpected event occurs that prevents the Officer from keeping an appointment, the Officer agrees to immediately notify U.S. Law Shield or the Contracting Attorney and work with U.S. Law Shield or the Contracting Attorney to reschedule the appointment.

  5. The Officer agrees to promptly inform U.S. Law Shield of all changes in his or her address or telephone number.

  6. Request for legal services may be initiated by calling U.S. Law Shield’s emergency hotline or by phoning the office listed on the U.S. Law Shield – Law Enforcement Only Program Membership Card.

EXPENSES NOT COVERED BY THIS LEGAL SERVICE CONTRACT

The Officer acknowledges and understands that certain services and expenses are not covered by this Legal Service Contract. The Officer expressly agrees that, in addition to any amount paid under this Legal Service Contract, the following expenses must be paid directly by Officer:

  1. Any expenses associated with court costs, and bail bonds. All such expenses shall be paid directly by the Officer, or, if U.S. Law Shield or the Contracting Attorney agree in writing, either may pay these expenses and Officer is responsible for reimbursing the paying party for these expenses. However, U.S. Law Shield and the Contracting Attorney are under no obligation to advance or pay any fees for investigators, trial consultants, or bail bond for the Officer, and any such expenses are not covered by this Legal Service Contract;

  2. Any expenses related to securing the testimony or evidence of non-local witnesses (other than those listed above under “Legal Services and Benefits” provisions hereinabove), including witness fees, or their travel expenses, lodging, etc.; and

  3. Any expense for optional coverage under this contract for which the Officer did not select and pay the coverage: i.e., Career Shield – Employee/Employer Relations Coverage, etc.

TRANSFERABILITY AND REIMBURSEMENT

This Legal Service Contract is not transferable and the benefits contained herein are not assignable and shall provide no amount for reimbursement of costs, fees or expenses not specifically covered by this Legal Service Contract.

CANCELLATION AND REINSTATEMENT OF LEGAL SERVICE CONTRACT

  1. The Officer may terminate this Legal Service Contract by providing U.S. Law Shield with written notice of the Officer’s intent to terminate this Legal Service Contract no later than seven () days after the effective date of this Legal Service Contract.

  2. If this Legal Service Contract is terminated by the Officer in accordance with the paragraph above, and the Officer has not sought legal services under this Legal Service Contract before termination, the Legal Service Contract is void and U.S. Law Shield shall refund the Officer any contract fee advanced by the Officer.

  3. U.S. Law Shield may cancel this Legal Service Contract by mailing written notice of the cancellation to the Officer’s last known address according to the records of U.S. Law Shield. U.S. Law Shield must mail notice before the fifth (5th) day preceding the effective date of the cancellation. The notice must state the effective date of the cancellation and the reason for the cancellation.

  4. U.S. Law Shield is not required to provide prior notice of cancellation if this Legal Service Contract is cancelled because of:

    1. Nonpayment;
    2. A material misrepresentation by the Officer to U.S. Law Shield;
    3. A material breach of this agreement by the Officer; or
    4. Termination of this Legal Service Contract by the Officer.
  5. If this Legal Service Contract is terminated or cancelled, U.S. Law Shield will reinstate this Legal Service Contract, with all rights and benefits, within thirty-one (31) days after the date of termination or cancellation, provided this Legal Service Contract was not cancelled pursuant to subsection 4(b) or 4(c) above, provided no use of force incident has occurred during such 31 day period and provided the Officer remits to U.S. Law Shield within the thirty-one (31) day grace period all contract fees then due under this Legal Service Contract.

MISCELLANEOUS PROVISIONS

  1. No change to this Legal Service Contract is valid until the proposed change has been approved by an executive officer of U.S. Law Shield and such change is endorsed or attached to this Legal Service Contract. There shall be no modification of the contract fee due under this Legal Service Contract while this Legal Service Contract is in effect. The contract fee may be modified upon renewal of the Legal Service Contract on the anniversary of the effective date.

  2. Complaint and Grievance. Any and all complaints and grievances between the Officer and U.S. Law Shield or any of its affiliates and/or the Contracting Attorney or any of its affiliates shall be submitted to binding arbitration in Harris County, Texas, pursuant to the terms and provisions of the American Arbitration Association. Legal Service Contract Holder expressly waives the right to proceed with any legal action, other than on an individual basis in an arbitration proceeding described herein. Legal Service Contract Holder specifically waives the right to proceed with arbitration in the nature of a class action or a class wide arbitration, and expressly waives the right to proceed in any court on a class basis or class action basis.

  3. The Officer may at all times retain counsel other than the Contracting Attorney provided under this Legal Service Contract; however, the Officer shall be responsible for all attorneys’ fees, costs and expenses of this different counsel and shall receive no reimbursement under this Legal Service Contract for fees or costs charged to Officer by this different counsel.

  4. Subrogation Rights. There are no subrogation rights under this Legal Service Contract, although Officer agrees to allow U.S. Law Shield to seek any reimbursement for such legal services under any applicable state or federal statute requiring the employer to provide legal services to Officer, where the employer fails or is unable to do so.

  5. It is expressly agreed and understood that NO PROMISES OR GUARANTEES as to the outcome of any case (past, current or future) have been made to the Officer by U.S. Law Shield or Contracting Attorney. It is further expressly agreed and understood that no other representations have been made to the Officer, except for those set out in this Legal Service Contract or in any changes to this Legal Service Contract approved by an executive officer of U.S. Law Shield and endorsed or attached hereto.

  6. Officer acknowledges and understands that the sales representative named above may be paid by U.S. Law Shield and that other fees for marketing, advertising promotion, etc. may be paid as well.

  7. The Officer agrees that he or she wishes to receive periodic updates on the U.S. Law Shield – Law Enforcement Legal Defense Program, activities of U.S. Law Shield activities of Contracting Attorneys and updates on law, or other information concerning relevant legal issues by email or regular U.S. Mail.

  8. The Officer acknowledges and understands that U.S. Law Shield or the Contracting Attorney may engage local counsel, associate counsel, or other attorneys to assist with the representation of the Officer, and that the Officer shall not incur any additional charges if U.S. Law Shield or the Contracting Attorney engages additional counsel on the Officer’s behalf.

  9. If the Officer’s agency, employer, or jurisdiction provides the Officer with legal representation related to an incident for which the Officer would be entitled to the benefits of this Legal Service Contract, upon the Officer’s request, U.S. Law Shield will engage a Contracting Attorney to provide the Officer with independent legal representation and/or advice to represent and protect the Officer’s individual interests.

  10. There are no deductibles or copayments under this Legal Service Contract.
